Himes Statement on Court Ruling on Alien Enemies Act

Washington, DC — House Permanent Select Committee on Intelligence Ranking Member Jim Himes (CT-04) today released the following statement:

“The decision by a Texas District Court judge to block the Trump Administration’s invocation of the Alien Enemies Act is a victory for the rule of law and due process. Trump has sought to use this power, which requires a finding that Venezuela is perpetrating an “invasion” or “predatory incursion” of the United States, to sidestep basic due process in deporting hundreds of people. As witnesses from the Intelligence Community confirmed in open testimony to the House Intelligence Committee, there is no basis to conclude that the requirements for the application of the Alien Enemies Act have been met. I have called on the Director of National Intelligence to declassify additional information. Going forward, I hope that courts insist the Administration provide evidence for its assertions that Tren de Aragua acts at the direction of the Maduro regime.”
